Welcome to Apex & Fable! These Terms & Conditions (“Terms”) govern your access to and use of the Apex & Fable website, including any content, functionality, and services offered on or through the Site, and your purchase of products from us.

By accessing the Site or purchasing products, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to all of these Terms, please do not use the Site or purchase our Pieces.

1. Use of the Website

  • Eligibility: You must be at least 18 years old or the age of legal majority in your jurisdiction to use this Site and place orders.
  • License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes, strictly in accordance with these Terms.

    • In any way that violates any applicable local, national, or international law or regulation.
    • To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by us, may harm Apex & Fable or users of the Site.

    • To transmit, or procure the sending of, any advertising or promotional material without our prior written consent, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
    • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site.
  • Account Security: If you create an account on our Site, you are responsible for maintaining the confidentiality of your account information (including your password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. Products, Pricing, and Orders

  • Product Representation: We strive to display the colors, features, specifications, and details of the Pieces available on the Site as accurately as possible. However, we do not guarantee that the colors, features, specifications, and details will be accurate, complete, reliable, current, or free of other errors. Your electronic display may not accurately reflect the actual colors. All Pieces are subject to availability, and we cannot guarantee that items will be in stock.
  • Pricing: All prices are listed in US Dollars (USD) unless otherwise stated. We reserve the right to change prices for Pieces displayed on the Site at any time and to correct pricing errors that may inadvertently occur. Shipping costs are outlined in our Shipping Policy and calculated at checkout.
  • Order Acceptance: Placing an order constitutes an offer to purchase. We reserve the right to accept or reject any order in our sole discretion. We may refuse service, cancel orders, or limit quantities if we believe customer conduct violates applicable law or is harmful to our interests. An order confirmation email does not signify our final acceptance of your order.
  • Payment: You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. Payment must be received before we begin processing your order for shipment. All payments are processed through our secure third-party payment processor. By submitting your payment information, you grant us the right to provide this information to the payment processor to facilitate your purchase. You represent and warrant that you have the legal right to use any payment method(s) utilized.
  • Cancellations: Order cancellation requests are subject to the terms outlined in our Refund and Returns Policy. Cancellation windows are limited as orders are processed quickly for shipment.

3. Shipping and Delivery

  • All matters related to shipping origins, delivery times, customs duties, and address accuracy are governed by our Shipping Policy. Please review it carefully. Title and risk of loss for all Pieces ordered pass to you upon our delivery to the shipping carrier.

4. Returns, Refunds, and Exchanges

  • We accept returns and exchanges for eligible items, including for reasons such as size exchanges or if you change your mind, as well as for damaged, defective, or incorrect items.
  • All returns are subject to the specific conditions and processes detailed in our Refund and Returns Policy. Please review this policy thoroughly before ordering to understand eligibility, return shipping responsibilities, and our process for items returned to our facility.

5. Intellectual Property Rights

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Apex & Fable, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

  • Our Designs: All graphics, logos, designs, and artwork featured on our products and the Site (“Designs”) are the exclusive property of Apex & Fable.
  • Restrictions: You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site or featured on our Pieces, except as necessary for your own personal, non-commercial use. Our brand name, logo, slogan (“Wear Your Story”), and all related names, logos, product and service names, designs, and slogans are trademarks of Apex & Fable. You must not use such marks without our prior written permission.

6. User Content (If Applicable)

Suppose the Site allows users to post reviews, comments, or other content. In that case, you grant Apex & Fable a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the User Content that you post.

7. Disclaimers

  • “As Is” Basis: The Site and all Pieces purchased through it are provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • No Guarantee: Apex & Fable does not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Apex & Fable, its affiliates, directors, employees, agents, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the Site or the purchase or use of Pieces, whether based on contract, tort, negligence, strict liability, or otherwise, even if Apex & Fable has been advised of the possibility of damages.

Our total liability to you for all damages, losses, and causes of action shall not exceed the amount paid by you, if any, for accessing the Site or purchasing the Pieces giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Apex & Fable, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site’s content, services, and products other than as expressly authorized in these Terms.

10. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the internal laws of Pakistan without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts located in Karachi, Pakistan, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

11. Changes to the Terms & Conditions

We reserve the right, in our sole discretion, to revise and update these Terms from time to time. All changes are effective immediately when we post them. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes.
